Terms of Service

These terms are an agreement between you and Flying Car AI ("we", "us"), the operator of Flying Car AI at flyingcarai.io (the "service"). By creating an account or using the service, you agree to them. If you don't agree, please don't use the service.

The service

Flying Car AI is an online service delivered through your browser. We may add, change or remove features over time. The service creates images or video from what you upload and describe, using AI models (MiniMax Hailuo H3). Results can vary, and the same request can give different results each time. AI results can contain mistakes, so check them before you rely on them.

Your account

You must be at least 18, or the age of majority where you live, to use the service. Give accurate information, keep your sign-in details safe, and tell us right away at support@flyingcarai.io if someone else uses your account. One person per account: don't create several accounts to get around limits.

Credits

Features that use credits show their cost before you start. If a task fails or is blocked by our content checks, its credits are returned.
Credit packs are one-time purchases. Their credits expire 12 months after purchase.
When you have credits from several sources, the ones that expire first are used first. Credits have no cash value and can't be transferred or exchanged for money.
When a payment is refunded or disputed, the credits it added are taken back.

Payments

Credit packs and prices are listed on our pricing page. Prices are in US dollars. Sales tax or VAT is added at checkout where it applies.
Credit packs are one-time charges, authorized at checkout. Nothing renews automatically.
Who sells your order. Checkout is handled by Waffo (Waffo.com Limited), our online reseller and merchant of record. It is the seller of record for your purchase, collects any sales tax, and also handles order-related inquiries and returns. The charge on your statement shows its name or ours.
Your card details are entered on the checkout page of Waffo (Waffo.com Limited). We never see or store your full card number.

Refunds

If something went wrong with a charge, such as a duplicate charge or a charge you did not authorize, tell us at support@flyingcarai.io within 14 days and we will refund it. Because your credits are ready to use as soon as you pay, we can't offer refunds when you simply change your mind, except where the law gives you that right. When a payment is refunded, the credits it added are taken back.

Billing problems

If you believe a charge is wrong, please contact us at support@flyingcarai.io before disputing it with your bank. We reply within 2 business days and correct confirmed billing errors within 5 business days.

Acceptable use

Use the service only for lawful purposes. Don't:

break any law, or infringe anyone's copyright, trademark, privacy or other rights;
harass, threaten, defame or impersonate anyone;
create or share content that sexualizes minors, or violent, hateful or illegal content;
try to get around our limits or content checks, gain unauthorized access, or disrupt the service;
use the service through scripts or automated tools, or resell access to it, without our written permission.

Our Acceptable Use Policy lists the content you may not create or upload, how we check content, and how to report it. It is part of these terms.

What you upload and create

You must own what you upload or have permission to use it, including permission from anyone who appears in it. Permission doesn't allow the deepfakes listed below.
Don't create deepfakes of real people: face swaps, "undressing" or nude images, sexual or intimate scenes, or images that show a real person doing or saying something they didn't. This applies whether or not the person agrees.
We check uploads, requests and results automatically before and after creation, and may block a request, remove content, or close an account that breaks these rules.
You keep the rights you have in what you upload. You give us permission to store and process it only to run the service for you. As between you and us, you own the results you create and may use them for personal and commercial purposes, as long as your use follows these terms and the law. Other people may create similar results from similar requests.
We don't use what you upload or create to train AI models.

Suspension and termination

We may suspend or close your account if you break these terms, if we suspect fraud or abuse, or if the law requires it. If we close your account for a reason other than a breach of these terms, we will refund the credits you bought and have not used. You can stop using the service and delete your account at any time in your account settings.

No warranties

The service is provided "as is" and "as available". We don't promise that it will always be available or error-free, or that every result will match what you had in mind.

Limit of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing. Some places don't allow these limits, so they may not apply to you.
